AGP Attorney Marina Abramova successfully defended an employer in a complicated labor dispute
For around a year a district court of Moscow was examining the claim brought against a major advertising agency by its former employee claiming invalidation of his termination and reinstatement in job. The plaintiff claimed that the termination by parties’ agreement was illegal because pressure had been put on the plaintiff and he had been driven to a condition that he could not remember the fact or circumstances of the termination, and in substantiation of his claim the plaintiff produced opinions of a handwriting expert and a psychologist and claimed that the termination documents were false. During the hearings, witnesses of both parties were interrogated and handwriting and technical expert examinations conducted. Having assessed the overall weight of evidence and taken into consideration the prosecutor’s opinion, the Court dismissed the former employee’s claim.
