Refusal to Perform a Government Contract was Upheld and Unfair Supplier was Included in the Black List

A government customer refused to further perform a government contract and submitted a request to the Federal Antimonopoly Service’s Office for the Moscow Region to include the supplier in the Suppliers Black List. The reason for the customer’s refusal was incompliance of the goods quality with the contractual terms, which was evidenced by the expert examination conducted by the government customer.

During the examination of the request, the Antimonopoly Authority found that the government customer had complied with all the requirements of law and therefore the unfair supplier was included in the Blacklist of the Russian Federal Antimonopoly Service for a period up to December 30, 2017.

The supplier, being unsatisfied, brought a legal action to invalidate the government customer’s refusal of the contract. However, the Arbitrazh Court for the Moscow Region dismissed its claims in full. The Court’s judgement has gone into force.
