IP Court overruled Rospatent decision decalring registration of the trademark "bra-fitting" invalid

The "bra-fitting" trademark dispute continues.

On March 12, 2020 the Intellectual Property Court overruled Rospatent's decision which declared the trademark registration invalid for a greater part of the goods and services for which the registration  had been granted initially and ordered Rospatent to restore the trademark rights.

AGP partner Elena Gorodisskaya represented the client in court and proved i.a. that the Rospatent decision was rendered in violation of the procedure applicable to examination by the Patent Disputes Chamber of disputes on the grounds that did not appear from the appeal filed against the trademark registration.
