On refinement of Section VI of the RF Civil Code
01.11.2010, Ivan S. Zykin
An article by law firm’s Partner, Prof. I.S. Zykin was included in the collection of articles entitled “Fundamental Private Law Issues” the publication of which was timed to coincide with jubilee of Doctor of Law A.L. Makovsky. The article dwells on the necessity for drawing a clear line in Section VI of the RF Civil Code between various statutes (in particular, the personal, real, contract, and tort statutes) because each of them is distinguished by considerably differing specifics of regulation of conflict of law issues, including the extent of admissibility of autonomy of parties’ will.
